Appeals and payment

If, having received a fixed penalty, you wish to challenge it then this is what happens:

Firstly, you’ll need to write to us or email us with the reasons why you are appealing the notice. You can email us at environmental.health@southderbyshire.gov.uk or write to us using the below address:

Please remember to include the unique serial number at the top right of the FPN.

When we receive your appeal we will take no further action until the appeal has been decided and you have been informed of the decision.

The appeal will be dealt with by a senior officer who has not had any involvement with the case. Every case is dealt with based on the evidence available, but generally the matters considered by the appeals officer are the same as the evidential test and the public interest test described in our Enforcement Policy. The appeals officer will provide a decision in writing within 14 days of the receipt of the appeal unless an extension is agreed.

Payment of a fixed penalty can be made by;

  • Calling our Contact Centre, where they can take payment over the telephone
  • Cheque made payable to South Derbyshire District Council
  • Cash payment at our offices in Swadlincote

We keep records of the FPNs issued, from issue through to payment or prosecution as well as relevant evidence. Records are kept in accordance with the Police and Criminal Evidence Act, the General Data Protection Regulations and our data retention policy.
