County-wide alcohol ban for ASB perpetrator

A three-year Criminal Behaviour Order (CBO) preventing a man responsible for anti-social behaviour (ASB) from drinking or carrying alcohol in an open vessel anywhere in Derbyshire other than a licensed premise has been obtained by South Derbyshire District Council’s Communities Team.

During a hearing at Southern Derbyshire Magistrates Court, Andrew Hogg, 53, of School Street, Albert Village pleaded guilty to breaching the Public Spaces Protection Order (PSPO) in Swadlincote town centre twice, on August 30 and again on October 14 in 2019.

Evidence about Hogg’s behaviour, incidents in which he has been involved and the effect that these have had in Swadlincote was provided by local shops and by South Derbyshire District Council’s Town Centre Community Safety Enforcement Officer.

The Council was awarded a three-year CBO against Hogg, which prevents him from acting in a manner that causes or is likely to cause a nuisance (harassment, alarm or distress) to one or more persons not of his household within Derbyshire and from carrying or consuming alcohol in an open vessel in any public place other than a licensed premise within Derbyshire.

District Judge Jonathan Taff told Hogg that if he breaches this CBO, he is going to prison.

In addition to the three-year CBO Hogg was given a two-year Conditional Discharge and order to pay £85 costs and a £21 Victim Surcharge.

A leaflet highlighting the Order will be produced and sent to local shops and businesses to make them fully aware of the conditions. Anyone witnessing Hogg breaching the Order should report it to the Council’s Anti-Social Behaviour Officer, Claire Rawlins, on 01283-595758 or the police on 101.

“Working in partnership with other agencies including the police we will continue to deal with any anti-social behaviour in the District.”
